ANATOMY OF A THREAT 3/MY VIEW OF ABUSERS
Someone e-mailed me the other day suggesting that no one is warning the public about Bernard Red Cherries being a danger to women. I take any suggestions and input seriously and did think about it. Should I put up some headline with a photo?? (I will put the link to his photo on the sidebar with other information for now you can find it on the previous post on this subject.) I’m really not trying to make a pariah of him…and these posts are not really about him. They are about the threats surrounding the issue and who the people are and why would so many adult men be up in arms defending child abuse to the point of threatening to harm women and children.
Obviously The Johnsons felt sufficiently frightened to delete all of their posts.
There is a shared responsibility in an abusive relationship. I do not have a popular opinion on abusive relationships. I have witnessed far too many of my female friends choose to stay in relationships when they had an easy out. Not all men who hit their wives do it because they are psychotic. It is was promoted and encouraged not to many years ago.
This is not the sixties or seventies though, it is 2009. The first time a man hits you it is his fault the second, third, fourth, fifth time? Women share an equal responsibility. In Oregon if you hit your spouse in front of your children it’s a felony. FELONY. If you are allowing your child to be abused by a spouse in many instances you are charged also. YOU ARE AN ADULT AND YOU ARE A PARENT. IT IS YOUR JOB TO RAISE AND PROTECT YOUR CHILDREN. SET AN EXAMPLE!
Children are the only innocents in the case of abuse…excepting instances where a spouse is locked up and chained. Even though we hear horrific stories about stalking and kidnapping that is not the typical profile of an abuser. Women need to stop seeing them selves as less than men, and as equals. Women should never portray themselves as victims.
I was dating a man once and he was in a bad mood…got pissed off at me and knocked over one of those stacks of Pot-tarts on an end- cap in a grocery store…I walked out and never saw him again. Of course he called said he was sorry….yada, yada, yada and I was tempted its how we were raised we need men to be complete….bullshit. Unplug your phone and put it outside. Have some pride and dignity! That was the closest I have ever come to being hit by a man. As Oprah says you teach people how to treat you.
In this millenium you should not have children until you are adult enough to do right by them, protect them from abuse or witnessing it. I have a niece whose husband beats the crap out of her. The last time they charged him with a felony and there is a restraining order against him so he is not allowed to be around her or his children. He has on multiple occasions had sex with other women and one was underage. He moved in with another woman until she threw him out…and what did my niece do?She lets him move back in and hides him from the police. Actually the police know…it’s a small town but they get sick and tired of the on again off again…. She lives with her mother and her mother fully supports this. Now my niece is having another baby…#4 by this abuser. He doesn’t have a job either. She defends him with every bone in her body and puts him above her children. Children who observe their parents being disrespected or abused will grow up with a warped sense of what love is. There is no abuse, mental or physical in love.
In the state of Oregon there is WIC, free college, almost free rent, free day care….NO EXCUSE NOT TO LEAVE.
I imagine that the Indian reservations are behind the times because the UNITED STATES GOVERNMENT does not provide the medical, educational, and nutritional needs that they are supposed to. The statistics of abuse of Indian women are horrific.
Equally appalling is that the daughter of Bernard Red Cherries has come out publicly stating that she was abused by her father and still the Red Cherries cheerleaders continue to ignore her and CHOOSE to give unconditional and unquestioning support of him. (Reminds me of some government agents in the Anna Mae posts I also write!!)
His daughter does not seem to be a drama queen teen intent on “getting her father in trouble”, she is a beautiful young mother with a beautiful little boy and I hope that by speaking out she has broken the cycle of abuse that in most cases is passed on from generation to generation. I truly hope that her days are bursting with all of the joy and pride that this courageous young woman deserves.
Abuse is passed on from generation to generation I have had to make the phone call on members of my own family and not have them talk to me for years….only to have them thank me later.
YOUR POPULARITY SHOULD NOT BE A CONSIDERATION WHEN DEALING WITH ISSUES CONCERNING CHILD ABUSE. Child abuse should reported no matter the race or sex…..IT IS NOT A FAMILY ISSUE. It is not an issue of race or gender it is an issue for the entire community and the entire community should be involved. Why people insist on clinging to this notion from the 18th century….get with the times people.
Unfortunately too many times abusive males seem to have no end in their supply of women who are more than willing to defend and crawl after them….If a man ever disparages his last girlfriend or wife I won’t date him again. How a man treated his last mate is probably how you will be treated eventually. There are many men who overcome abuse through counseling but denial, blame and hiding is the first indication that you have not dealt with it. Abusing women and children is sort of like being a heroin addict rarely does one overcome it the first time that they try.
Some men will stop the physical abuse out of fear only to up the campaign of mental abuse. Believe me having been the recipient of many forms of abuse the mental crap is by far the most damaging-the most difficult to overcome.
Having said that as a society we need to stop the nonsense that boys are not abused. Most men that are abusers were abused as children or watched their mothers being abused and that is the example that was taught them by their parents. Most people learn how to interact with their mates by following their parents example. Very few mothers and fathers love their children more than they love their fear of being alone….their fear of looking in that dark place and discovering why you choose to allow yourself to be abused or why you choose to abuse. One behavior is no better than the other.
We assume that boys are not as affected by abuse and expect them to be stoic, not cry or complain. Plus they have the added obstacle of testosterone when it come to overcoming abuse. Men are genetically more disposed to be more successful (probably not the right word) at abusing…NOT SAYING THAT MEN HAVE AN EXCUSE FOR ABUSING…NOR DO WOMEN HAVE AN EXCUSE FOR STAYING (unless physically restrained). It is the same behavior on opposite sides of the spectrum.

I once dated this guy who was funny and smart but one night we were watching a movie with one of his friends and he made a comment about how the movie was portraying women different than reality. “Women are not as smart and as capable as men”….last time I saw him….and I really did like him. But he wasn’t joking and I am the type of person who loves my vagina so much that I could never allow someone who disrespected me or for whom I lost respect to get anywhere near it. Physically I cannot do it. Sometimes I look at women and the men who fuck them and wonder how in God’s name they could ever let their penis in their vagina…SEX IS SACRED AND INTIMATE….and you can buy perfectly good vibrators from Adam and Eve.
There is my warning for women dating abusive men. Tomorrow I will have a lot to say about the people jumping on the protect the abuser bandwagon.

See??? I’m writing another post finally! Funny how things grab you and don’t let go…the stuff over at Pudgy Indian was keeping me up. I sleep much better now that I have been writing about the threats….Some people its the opposite they get scared and can’t sleep until they hide…me I get scared and can’t sleep until I understand or confront it. Although the new series is twice as popular as the Anna Mae Posts…I think she resides in all of them!
When I last posted on Anna Mae Dennis Banks and Russel Means were on trial and the FBI had forged some documents..
…prosecution called Special Agent in Charge Joseph Trimbach to the stand, and WKLDOC took the opportunity to ask him whether the FBI had wiretapped the sole phone line that had been left running into Wounded Knee. The line was used only for negotiations between the besiegers and the besieged and for privileged conversations between the besieged and their attorneys. A tap on the phone would have been illegal without a court order, which the FBI did hot have. Trimbach testified there had been no tap.
Wow Joseph Trimbach and the FBI hold themselves above the United States courts….But as any intelligent human being understands the FBI was never about protecting democracy…which has never really existed in this country anyway.
…he was followed by Joe Pourier, a lineman from Bison State, the phone company that served Pine ridge. “He was a goon,” WKLDOC’s Sand Brim remembered of Pourier. “But he had been a childhood friend of Pedro Bissonette, and when Pedro was killed, Joe Pourier, like Poker Joe Merrival, flipped.
Pourier testified that he had set up a phone at one of the government roadblocks and tied it into the phone line that came out of wounded Knee so that the occupiers and the government could speak directly. That much was perfectly legal. But Pourier also rigged the government’s phone to work as a party line, a line the government could pick up and, anytime the occupiers were talking to their attorneys, eavesdrop on the conversation. It was a low-tech wiretap, but it was a wiretap all the same-and, without a court order, illegal.
When the defendants asked the government to produce the records for Pourier’s work, the government said the records had been destroyed….One of the FBI reports acknowledged that the FBI did not have a court order for the tap but said it hoped to get one soon. It never did. When Banks and Means asked why they had not been given the documents to begin with, the prosecutors said they had meant no harm; it was just that they had so many papers, they didn’t know these particular ones existed.
“You see, that’s the disturbing thing, ” Judge Nichol said. “We’re always finding out that the head of the bureau of the guy at the top never seem to know anything.
Joseph Trimbach was called back to the stand and asked why he had said the FBI had not wiretapped the defendants when it most assuredly had. Did he know about the tap at the time, or were his subordinates running amok?
Trimbach said he must have known at the time, only to have forgotten about it later.
Trimbach replied that while he may have technically authorized the withholding of the papers, he hadn’t really made the decision. His aides see, were forever sticking papers under his nose, and he didn’t always read them before signing them..
Before dismissing Trimbach, the defense asked whether he was aware that it was illegal to run a wiretap without a court order.
… he never thought of the party line as a wiretap. had he known it was considered a tap, why naturally he would have gotten a court order before letting it be installed.
…WKLDOC pried another paper loose from the FBI, this one an affidavit in which the affiant, whose name had been doctored out, formally requested that a judge legalize the wiretap. That is, the FBI’s affiant acknowledged that it needed a judge’s approval to listen in on the party line. Nichol forced the government to release an undoctored copy of the affidavit, and the affiant turned out to be none other than Joseph Trimbach. Once more Trimbach was called back to the stand.
Had he known about his own affidavit, the defense asked…
Trimbach answered that he must have read it-only he couldn’t recall a single thing about the affidavit.
The defense asked why the affadavit that Trimbach originally released to Banks and Means was missing the pat of the page that bore his name and signature.
Trimbach said he had no idea.
What a surprise…and does anyone wonder why Indians call it the “just us” system???

Eugene is a radio talk show host on a station called KBOO and a blog called PUDGY INDIAN 2
I have never met Eugene. Monica Charles once made a comment that I reminded her of Pudgy Indian ( the name of Eugene Johnsons blog). I checked out hid blog and we I can see the similarities…he takes a lot of pictures and puts them up on his blog and we are both emotional about different causes and injustices.
Eugene and his wife had taken on the abuse of women and children and now everything that they have written has been deleted because of a threat. One of the reasons for the threat was that ‘such negativity shouldn’t be addressed in public as people from the outside would use this as a weapon against the Indian community’. That of course was not the case what has been brought to my attention is that a blogger was threatened for posting. ON THE SUBJECT OF ABUSE??? Got my attention!!!!
I wonder why this was not a concern when Bernard Red Cherries decided to go on a radio show with his family problems? Isn’t that something that you consider before going on a radio talk show and giving your permission to the host to also put it up on a blog?

Lets start with CHIEF:
when I think of chief I see an Indian with a feather bonnet on his head ala old westerns. I don’t mean this disrespectfully. I’m just telling the truth. If you have ever read my blog I don’t hide that I grew up with a lot of racism and prejudice against Indians.
The definiton I found said the leader of a tribe. But I am looking for what it means today. For instance Dick Wilson wasn’t a chief he was a president.

The photography was beautiful! And there was so much information that I will have to watch it again in the future..
But here are some of the things I took away.
The problem the Northern Cheyenne face is that the U.S. government imposed a political system that was based on competition instead of cooperation-capitalism instead of selflessness.
The traditional chiefs are only symbolic now and only concerned with ceremony the IRA government is the political leadership and of course in today’s world has all of the clout.
A Cheyenne prophecy said that in 100 years the old ones would come back…you would see them in your children.
You can’t sit and wait for the prophecy to come true you have to make it happen.
Another thing just occurred to me. There were no women represented on the video. But I remember at the end of the film there were these 3 elderly women dancing at a Powwow and I was struck by how straight they were no slouching from those women!
It didn’t really answer my question or maybe it did.I don’t think that Bernard Red Cherries lives on the reservation or even in Montana because I seem to recall that he was living in Portland and now he lives in Oklahoma because on alt.native I found a link to a DUI in Oklahoma this year under his alias Robert Coltte. He also spent some time in prison in Nebraska for kidnapping . Wow you can get out in a year after kidnapping someone? What was it a goldfish?
But on a more serious note it was over 20 years ago. And coming from a long line of alcoholics myself….all of the males in my family on both sides were alcoholics for some reason it skips the women….Wow I wonder if its because they had to live with us women?
There was someone on alt.native threatening one of the women about the Bernard Red Cherries saga. Not a real threat was going to put her on some list on some website…I can’t remember who she was but lets have a look

of our children that is destroying the very fibers of our communities.

WHY??? did eugene johnson LIE about an upstanding Honorable Cheyenne Chief??? Yes, eugene johnson did offer an apology BUT he did state he was told too. WHY??? is eugene johnson still a DJ at KBOO??? WHY??? didn’t the station management stop eugene johnson from spreading these LIES!!! WHAT??? is KBOO management going to do to correct this and see that it NEVER happens again!!!

I am amazed at the power one person can have over so many lives and how the internet can quickly facilitate hate or love. This is very very curious to me.
What I do know
Two years ago a man named Bernard Red Cherries aka Frank Reynolds, Robert Coltte (not sure what that is all about the only alias I have is Betsy which is short for Elizabeth…I guess people have their reasons.) asked to go on a radio talk show because his daughter had run away. (I can find a few things about Bernard Red Cherries but they all surround an issue about the Sundance. Which I need more time to read. Complicated by me white folk!
Recently the step daughter contacted the talk show host and told the host that Bernard Red Cherries had abused her and her family.
The radio talk show host also has a blog and put up an apology to his readers and listeners because he felt he had been fooled by this man.
For some reason a man claiming to represent a group called PORTLAND AIM and a group called OKLAHOMA RED BROTHERHOOD (I can find no link to any organization to the Oklahoma Red Brotherhood…unions…firefighters…communists…. wait here is a passing blurb on a page called OKLAHOMA GANG THREAT ASSESSMENT you have to scroll down the page to a list of Native American gangs in Oklahoma…it says most are created in prison and you know what I feel about our prison system….does more damage than good and just another avenue to control our minority population…and when subcontracted to private corporations another avenue to fuck over the lower and middle classes…steal the tax payers money and furthering the repression and annihilation of minorities, the poor and the working class. See what I mean about being curious??? Everything is interconnected and one thing leads to another….) decided to take up the cause by issuing threats.
Maybe it was a Freudian slip but the Oklahoma Red Brother Hood accused the talk show host/blogger Eugene Johnson of accusing this Bernard Red Cherries aka Frank Reynolds aka Robert Coltte of sexual assault. No where on his blog did he ever use the word sexual. Kind of makes me wonder……

Now all of the posts and comments have been taken down…except I copied a few of them on my blog and Monica Charles copied a few onto alt.native.

Kill the Messenger
About 2 years ago, a man came to us at our radio show asking for our help in finding his runaway daughter. We assisted him to the best of our abilities, and when we asked if it would be OK to put the information out on our blogs, we did so.
Then, about 4 months ago, we started receiving e-mails from a former stepdaughter accusing this person, a spiritual leader of some sorts, of abuse. Although the letter below mentions sexual abuse, there was no mention of sexual abuse on my post nor done so by the person who alleged abuse in e-mails or in comments on the post that was made on this blog.
About a week and a half ago, I was called by the person, now the mediator in all of this. I asked if taking the post down would satisfy the person, as it was alleged by the mediator lawyers were talked with about possible litigation, and said person was told that he had a case. He said he believed it would be satisfactory to said person.
Upon taking down the post the next morning, I noticed that there had been a lot of action in the comments section, including the original allegations made by the woman who claims to have been his step daughter. Along with her comments were some rather abusive comments from anonymous folks, and so I have saved those items and took them off my blog knowing that a demand would come forth for an apology.
Two organizations have come forth demanding this apology, one being the Red Brotherhood Warrior Society, whom their representative wrote the letter below, and Oklahoma AIM. None of these folks from these organizations have come forth to tell me who they are and how they are involved in this. What set me over the edge, however, was when I was sent an e-mail from the mediator that Dino Butler wanted a copy of the information contained in the post and the comments that have been removed. I did so, also asking why the hell he is involved in all of this.
This afternoon, the mediator showed up at the radio station to talk with me. He told me that such negativity shouldn’t be addressed in public as people from the outside would use this as a weapon against the Indian community. There were also insinuations of all sorts of little threats, possible that something may happen to me, possible something may happen to others, the community who won’t come down and help with the show will definitely work to get me off of the air, that two lawyers (whose names I am not given and who haven’t talked with me) have been talked to about this issue, and so on. The one clear threat, however, is that I will be banned from all Indian events, and Portland AIM is alleged in helping with that issue. In fact, in a meeting I had no idea was taking place, I believe on Wednesday, Portland AIM had a meeting on this issue, so the mediator informed me.
Now, where is the consideration to the women and children who are victim/survivors of abuse. It is only men’s voices I am hearing. All of these people involved I have no idea who they are. I know the mediator hasn’t read what was written on the blog. I don’t think the lawyers have the information. With this allegation of abuse, I find it interesting that no Indians have complained about me bringing up issues of abuse from the various Christian organizations against Indians.
Where are the women’s voices? Where are the voices of the children? What is getting done about abuse prevention, and help for both victim and victimizer in Indian country?
Instead, what is happening here, is I am being bullied in an attempt to shut me up.
Here is the letter, and I removed the names of the folks involved in the original post, but not the name of the person attempting to force me to write a specific apology on my blog.

You have not held yourself to the high standards set forth by law, that you present and provide proof, when making public statements about a person. We have been authorized and have received the blessings by our people here in Oklahoma to proced on _______ and his daughter ____ behalf. It is a very sad situation when you start making attacks on the inter-net and giving it a platform to attack our Traditional leaders in public. We at the chapter encourage you MR Johnson to do your own investigation on ______ and discover the truth. All people have some amount of pain in their lives and _______ is not exempt. In our yrs of knowing him we have tolerated the attempts to ridicule, and out right lie about him. It has come time now that he needs our “Protection” from lies and untruths such as you have allowed in your forum, all without a (what you call!!) a thread of proof. In closing if you want to ask any questions please forward any of your concerns to our A.I.M. brother ___________, we have already had conversations with him and he knows our concerns int his regard and anticipated apologies from yourself. And we would hope that this could happen as soon as possible. What I don’t know is what all of this really means so in the next post I will start investigating the answers to each and everyone of my questions…and I have more than a fifty on the yellow legal pad in front of me and just this morning I added another 10….one thing leads to another….
Let me end this by saying that in no way am I determening guilt or innocence on any abuse allegations. I have seen abusers lie and blame others…I have seen mothers turn against their daughters who were even being raped by their fathers (happened to my best friend Shawna when I was in the seventh grade). I have also known girls who accused innocent men of rape because their parents caught them doing something they shouldn’t have….luckily they confessed to their crimes after being questioned…but I know they don’t always. I detest these self serving people who are either trying to save them selves or get attention….THEY RUIN THE CREDIBILITY OF REAL VICTIMS WHO COME FORWARD AND CAUSE MUCH DAMAGE FOR EVERY OTHER VICTIM OF ABUSE.

I am either going to have to start a new blog or rewrite the description. Since I got a computer and started the blog…since my new friend Monica Charles contacted me about a Buffy St. Marie song I commented on….I have been writing about Indian issues.
One of the bloggers whom I admire but have never met has been threatened recently and I don’t know why. Posts on this subject have been deleted from his and his girlfriends blog. I am going to assume it is because the threats against them have been too much. I have been called a lot of names and hints at threats if I ever came into the persons town….but I don’t take it seriously. This threat is more serious with people showing up at his work claiming to represent Portland AIM (there is nothing on their website about this) and a man named Bernard Red Cherries. As a white person this is not the world I experience and live in. I do not know the whole story and will reserve my judgment about the subject of abuse. But what I do know about is that a fellow blogger whom I have never met was threatened. I am horrified and saddened at threats of violence and I will pray daily for all parties involved. I don’t want to inflame the issue but I don’t understand it. These are new worlds to me blogging and Indians…this is about both…and like the Anna Mae posts I will not stop until I decide to stop…some of my friends and family are less than enthusiastic about all of the posts about Native Americans. There are a lot of people who have criticized me and even told me I was stupid but I figure I must have hit a nerve as they protest too loud….white guilt perhaps or just outright racism.
A few years ago I was working for a company that I was trying to unionize and there was this older man who was from Peru who I was trying to help….the INHUMANE resource officer named DEBBIE WOLFSLAYER was on a regular basis cheating him out of his paid vacations and holidays. He said to me one day “THE ONLY THING I HAVE TO DO IN THIS WORLD IS DIE”. That has been my motto ever since.
I am not giving up on the Anna Mae posts but because I am so disturbed and don’t quite understand why the threats were made I will be learning more about that.
The following was written by Monica Charles. I love and admire her she is one of the most mentally strong women I have never met! Not a fake ass bone in her body and she mourns over her history and her cries ring through the Internet.

This isn’t what we are about. We protect our children, we don’t abuse
them. We don’t attack those who protect our children. If our children
are our future then why aren’t they the most important focus in our
lives? If our children are our future why are they hungry? Why are
they drinking and doing drugs? Why are they committing vandalism? Why
are they growing up without fathers? Why are they running away from
home? Why are our babies having babies? There was a time when men
really were the protectors in our communities. There was a time when
men knew their children and raised them to adulthood then became
Grandfather. There was a time when we could count on our men. The
Creator gave men physical strength to protect and feed The People.
Today many of our own men are the dangerous ones in our communities.
Today many of our own men beat and rape those that they are supposed
to protect. Our children are sacred because they have come to us
directly from Spirit. They are still speaking the language from where
they came until they learn ours. If we abuse them they can simply
decide to die and they will. We have to be careful how we treat our
children. We must raise them as the sacred beings they are. Our old
people are sacred because they are getting ready to return to Spirit.
They carry all of our history and our knowledge. Women are sacred
because they represent Mother Earth. All power and knowledge travels
through Woman. When you beat and rape a woman you are actually beating
and raping Mother Earth. When you beat and rape a woman you are
beating and raping all of our Traditional Teachings and Spiritual
Knowledge. When you beat and rape a child you are beating and raping
our future. It is time to call forth that sacredness in our men. We
must require them to be what our Creator intended, what our Ancestors
AGREED to be, to protect and feed The People. If you don’t do that
then we are doomed.

The saga of Pudgy Indian continues and I really have to wonder if this wasn’t a good thing. Light coming to a dark subject is always a good thing. I wonder if Autonomous AIM really supports the inappropriate behavior of some of their members or if there are just some overly enthusiastic people who are acting without thinking the issue through….you know take your friends side blindly. Apparently one of the leaders of Portland AIM was appointed by Dennis Banks himself. I don’t know Dennis Banks or that much about him…but it seems to me while reading THE UNQUIET GRAVE that he has probably figured out that this nonsense is just that….non sense. There are a lot of comments about what a bad person he is or was with the drinking and womanizing. Being a woman I get frustrated at the AIM leaders who do not protect women…the stuff about his sex life and his children beating up women while horrific is really no different than Paul McCartney. Jimmy Page was the worst carrying around a special suitcase of whips to beat his groupies…I don’t think that Dennis Banks was abusing women for gratuitous reasons like Jimmy Page was. I think it is more conducive to someone who was ripped away from his family and thrown in a boarding school….it takes a tremendous effort to overcome the cycle of abuse. When you consider the resources that have been historically available to the Native population it is a miracle and a blessing when just ONE Indian can stop the cycle of abuse. It is not easy and to blame men for all of the ills is too easy. I myself am guilty of it…as evidenced by some of my rants on the blog. Sort of like the poll WKLDOC took in this installment, it is easy to answer by pointing your finger at the obvious scapegoat. Right or wrong. The problem is more complex than that. Its just that women are brainwashed from the day that we are born that men will take care of us. That men are in some way superior….that we should hold them to above us. And of course our society reinforces this by denigrating the importance of stay at home mothers, unequal pay etc.. So by the time I figured out that I had been lied to….I was pissed off. Sort of like being pissed off about the quality of teachers in the schools teaching American History!! My whole existence as an American is a lie. The history of the country I grew up in is just an empty lie. And I believed every word of it!!!
Here is the PORTLAND AIM WEBSITE. I used the search to look up Bernard Red Cherries and Eugene Johnson and came up with nothing. So either they have nothing to do with the nonsense going on or their website is like a false store front in a ghost town. In which case the movement that may have started out with good intentions is already insignificant…they just haven’t figured it out yet. The moment AIM became insignificant in the previous decades was the moment they allowed fear to creep into their minds and they started hiding their actions which started a chain of paranoia. It is the history of every revolutionary group. DIVIDE AND CONQUER!! It doesn’t matter how many times the government does it….people fall for it every single time. WE NEED TO STOP LETTING THE GOVERNMENT DIVIDE US. And the care and safety of children should be put above all else.

Dennis Banks and Russell Means were the first of the Wounded Knee defendants to be tried for the takeover. They asked Bogue to recuse himself for blatant bias, and much to their surprise he did.
The case fell to Fred Nichol, a prairie moderate, former prosecutor, and chief federal judge for South Dakota. Nichol intended to try the case in the state until WKLDOC commissioned a survey of bias among South Dakotans. the the question “What should be done about Indian militants, American Indian Movement members, and other Indians who demonstrate claiming they haven’t been given equal rights?” the most common answers were “Jail ‘em” and “Shoot ‘em”. Judge Nichol moved the trial to St. Paul. It started in January 1974.
People give answers to polls like that without giving it any consideration because it does not effect them…..who cares abut Indians getting a fair trial? If only they would play the game and get in line….Now I’ll bet if you polled white South Dakotans standing in line waiting to pass through airport security with their shampoo and nail clippers….
Banks and Means served as their won co-counsel, backed by some of the country’s most accomplished trial lawyers. These including the gifted embellisher Mark Lane, the meticulous Ken Tilsen, and the wild-haired, brass-tongued Bill Kunstler, whose clientele included Martin Luther King Jr., Black Panther Stokely Carmichael, the Chicago Seven from the 1968 Democratic Convention, and the antiwar Berrigan brothers.
Hurd and Geinapp agrgued a straightforward criminal case; Banks and Means had conspired to riot, seize, and hold Wounded Knee and then had done so, along the way destroying property, taking hostages, and firing on officers of the law.
The defendants denied everything…
Every time the Oglalas and their allies in AIM tried to right the reservation’s many wrongs, federal and tribal governments blocked them with duplicity, persecution, and terror. The Indians had been left no choice but to break the law.
The key to this defense lay in destroying the government’s credibility and Banks and Means caught a break early when the prosecution called a witness to disparage a petition signed by 70 percent of the permanent residents of Wounded Knee.
the copy the government produced at trial was doctored to seem weaker. On cross examination, the defense proved that the FBI had had custody of the petition at the time it was doctored. An FBI agent was called to the stand to explain how the document had been altered. The agent was at a loss. He said the FBI had a lot of files on Wounded Knee and it was hard to keep them all straight. Perhaps there had been a clerical error.
Judge Nichol declared himself “greatly disturbed” by this answer. “I used to think the FBI was one of the greatest bureaus that ever cam down the pike. I think it’s deteriorated, and I don’t care how may FBI agents are here in court listening to me.
…Judge Nichol to ask exactly how many the FBI had on Wounded Knee. He was astounded to learn 315,000. WKLDOC was astounded too. the government was bound by law to give the defense nearly all of its files that might help exonerate the defendants, but Banks and Means had not received anything approaching 315,000. they asked Judge Nichol to find out whether all appropriate files had been handed over, and Nichol forced the prosecution to give the defense 200 of the unseen files as a test. Half of the 200 files turned out to be relevant to the defense and should have been handed over months earlier.

ANNA MAE AQUASH 44/ THE FBI CONTINUES IT’S CAMPAIGN OF HARASSMENT4

I finally watched the video produced by and starring Richard Two Elks (watch it here )it is a response to the PBS documentary WE SHALL REMAIN the WOUNDED KNEE segment. There are so many people involved in this case with so many opinions I am continually amazed at how many people are upset some houses are burned down and not concerned about a little girl being shot in the eye or a teenage boy being given alcohol and a moving vehicle by the tribal president. I detest people that step into public office or in a position of authority over other people and fail to set a good example whether it is popular or not. Your job as an adult is to set a good example to the younger generation. Period.
Getting back to the video Two Elks claims to be a professional but the video is poorly produced. If he were just a hobbyist I would say “It’s great!” In the video he is wearing a hat. Maybe that is an Indian thing but men should take their hats off while indoors much less while you are on camera. The hat is covering most of his face and he doesn’t really look in the camera….he is reading from something written that he is holding. Most professionals would have a teleprompter or someone holding up large cards so he could read the script. I say script because he does not seem to be familiar with the subject he is just reading something that someone wrote. This should be a subject that he knows so well that he can speak with authority, conviction and without having to write it down. It also lacks any passion for the victims of Wounded Knee it seems their purpose is only to further their propaganda. I mean are these victims of Wounded Knee sleeping on the ground? Or in a cardboard box? It has been over 30 years. I have heard nothing of any organization that either Trimbach or Two Elks has started to help these supposed victims. The video says nothing about their plight now or what you need to send them to get them back on their feet. The trading post didn’t have insurance??? What state lets you own a business without insurance? Even then. Like I said my impression is that neither Two Elks or Trimbach gives a damn about these victims because in the big picture it is a non issue. But once again why the continued outrage from so many about some possessions…take my house and everything I own…burn it to the ground…I would rather have my eye! Not one word about the little girl who was shot in the eye!!! People these days do not have their priorities straight. Children first! It is the only way our civilization will begin to heal from the cycle of abuse of any color.
Richard Two Elks has come forward and admitted that he murdered a person by beating him to death at Wounded Knee but he has never been charged or spent a day in jail. I think that under the circumstances none of the participants at Wounded Knee should be convicted it was a painful era in the history of our country. AIM and its members were understandably expressing their grief over the genocide and annihilation of their people for a few hundred years. Frustration and the feeling of powerlessness often lead to people going to extreme measures as evidenced by the rise in school shootings. On the other hand Richard Two Elks also claims to work tirelessly on the sexual abuse of children yet he continually taunts a woman who was sexually abused by her father on a native discussion group. The former FBI agent Joseph Trimbach apparently approves of this behavior as he remains silent about this behavior and whole heartedly supports everything Richard Two Elks does. As much as I admire and respect Anna Mae Aquash I am in no way as upset about her death as I am about a little girl getting shot in the eye. Right or wrong politics aside Anna Mae went to Wounded Knee knowing that involving herself in the situation could very well result in her death. She made a choice and should be admired for doing so.

The harassment of the WKLDOC by the FBI did not end there, hours after the release of Feiten and Davies they ran into the FBI in the hotel lobby. the FBI agents commenced with harassment and the lawyers tried to put the FBI agents under citizens arrest the altercation moved to the street and when the police arrived they actually arrested one of the FBI agents.
...both agents were soon released, but three days later the city attorney charged Pearson with assault and issued a warrant for his re-arrest. Pearson left town the same day.
Joseph Trimbach, the FBI agent in charge of the Dakotas and Minnesota, said Pearson’s departure from Rapid City was just a coincidence; he was not fleeing an arrest warrant, only being rotated back to his home office in California. When reporters asked if the FBI would return Pearson to Rapid City to face the charge, Trimbach scoffed at the idea. “This is a trumped-up charge,” he said. “There is no basis for it….It is absurd on its face that FBI agents would harass the militant Indians or their representatives”. He denied that his men had been put under citizen’s arrest, although they most certainly had, and he added that the arrests of Davies and Feiten had been “valid arrests,” although they most certainly had not.
WKLDOC then began to experience mail being delivered late or not at all anonymous threats over the phone, and other such goings on. They assumed that they were under surveillance of the FBI
WKLDOC filed suit against the FBI for creating a climate that scared its clients from meeting with their lawyers: the FBI cast a pall over the constitutional right to a fair defense.
The case was heard by the ever so corrupt and racist Judge Bogue…
“It might be noted,” Bogue opined, “that many of the acts complained of by the Plaintiffs seem to have been occasioned by the activities of the Plaintiffs themselves. The incidents, occurring while investigating F.B.I. automobiles, photographing agents, and investigating the Defendants’ housing, seem to have occurred when the Wounded Knee Legal Defense/Offense committee was taking the action to the Defendants. It appears that many of these incidents may have been avoidable by Plaintiffs.” It was the same logic that held a woman need not fear being beaten by her husband if she did not raise her voice.
Bogue dismissed the case.

People In Hell Want Ice Water
Most of us have grown up with the idea of Satan as arch-fiend, responsible for every perceived evil in the world. It is at Satan’s hands that the innocent Jesus of Nazareth is tempted in the wilderness, betrayed by Judas, and ultimately suffered a death reserved for the most despicable of criminals. Every despot, dictator, and tyrant has been relegated to the ranks of this malefactor’s army of evildoers. He is evil incarnate, a symbol and instigator of man’s most despicable inclinations and tendencies…Yet, we are fascinated by him. A cursory glance at the audience of any televangelist’s rantings against the Evil One will shows many of the audience positively shuddering with ill-concealed delight. Just what is it about Satan?
Milton has set himself a stern enough task. He has assured us he will justify the ways of God to man. This is a Herculean labor in itself. Even the most casual observer of life has to wonder about the abundance of evil in a world presumably controlled by an omnipotent, beneficent deity that apparently lets Satan and his cohorts wreak havoc on humanity at will. Much like the author of Job, Milton takes no great pains to hide this fact. And like the author of Job, Milton unveils an aspect of God that deeply disturbs: God not only passively allows Satan to torment humanity, He condones it. God’s passivity is done under the guise of free will. In exchange for a lifetime of being Satan’s personal voodoo dolls, we are offered the glorious opportunity of loving and yea, even worshiping the mighty Yahweh that allows this to happen to us. The careful reader of this text will note that God never takes action unless He or His personal kingdom are being threatened. God is painted as a laissez-faire administrator of divine justice. Satan is fully aware of this and it not only incenses him, it inspires him to “greater” deeds. This is one of Satan’s attractive attributes. He is a doer and unlike God, Satan expounds an extraordinary amount of effort into his works. He has goals and he works hard to achieve them. Everybody loves a self-made man. Satan is also a seeker of knowledge while God is insistent upon keeping Adam and Eve in the dark. He does not want them seeking knowledge on their own. It is no wonder Jesus begs us to act like sheep, this way it is easier to pull the wool over our eyes! In contrast: The Biblical Yahweh is portrayed walking and talking with Adam and Eve in the garden. At the point in Milton’s text where God realizes he needs to forewarn Adam and Eve of Satan’s impending visit, He is too uncaring and unmoved to warn them himself. He sends his lackey Raphael to do it for him! Satan leads a “life” of passion and conviction. God is just…there.
I don’t believe for a moment that Milton tried to paint a pretty picture of Satan to show us how easily we are ensnared by his wiles. The disgusting and entirely-too-vividly rendered scene Milton creates regarding the birth of sin and death, tell us much of the filthy perversion of Milton’s mind, and in fact, help negate the unseemly characteristics Satan may possess. Satan is truly the most interesting and engaging character. Satan’s underlings are dolts for the most part. The heavenly host? Mere automatons. Adam and Eve are totally clueless, and Jesus and God the father are co-reigning Kings of the Dullards!
There is something entirely Quixotic about Satan. In a sense, he seems oblivious to his inevitable defeats at the hands of the heavenly host but he keeps trying…and succeeding to an extent. He may have lost the battle but Satan fractures heaven single-handedly and causes God to lose a third of his angels. The creation of earth, Adam and Eve, and the cosmos is a direct reaction to Satan’s rebellion. The fall of Adam and Eve? Guess who? Satan wins enough battles to keep us engaged and secretly rooting for him. The closest analogy I can think of is the Roadrunner and Wile E. Coyote. Who has not wished the Roadrunner would suffer a good neck-wringing at the hands of the hapless hound?
I don’t know that Milton intended this but one could easily regard Satan as the first real human. Unlike the rest of Yahweh’s angels, Satan appears to have free will and an understanding of the events surrounding him. He is ambitious and passionate. He is aware of his power and personal beauty. He is an original thinker and unswayed by the blustery pronouncements of Yahweh. In the manner of Adam and Eve he is cast from his own paradise but he will not bow down or ask for forgiveness. He can’t. In his own way he refuses to be a hypocrite!
One may wonder at Satan’s consuming passion in wreaking havoc on God’s works. Why not make a heaven of hell and forget about God? Why torment himself with Adam and Eve, the earth, etc.? He is possessed by an all-consuming desire for revenge. Scratch beneath the surface and you find an emotionally scarred human and this is Satan’s most appealing feature and the easiest to empathize with. Satan is an outcast suffering from rejection, isolation, and despair. Who among us cannot look back to our past and recall a similar incident from our own lives? The wrong thing said, the foolish thing done. The sudden isolation from one’s peers. The wavering between yearning for inclusion in the group or the courage to go your own way. Milton, The Lady of Christ’s Church: “They thought themselves gallant men and I thought them fools.” This statement has the ring of more than a little bitterness. For a time, Milton had his revenge as one of the leading writers of a theocracy that virtually morally handcuffed an entire generation. But this too passed and once again Milton found himself on the outside, his theocracy and paradise on earth brought to nought. Unsaved and unprotected by the God it purported to represent.
Milton had a marvelous propensity for interpreting the Christian religion as he saw fit and forcing it to serve his own needs, his pamphlet on divorce being one of several striking examples. It is my opinion that Milton’s rendering of Satan is an unconscious self- portrait and more. In Milton’s blindness he sees more clearly than even he himself knows: For when we gaze into the mirror of Paradise Lost we see ourselves as we truly are: Human, all too human.*

MY LATEST TRIP TO EASTERN OREGON
I love traveling! I get to see so much of the countryside!! I was going to go camping but I thought Memorial Day was next week! I hate to be around the crowds so I came back home yesterday. I have the luxury of taking off whenever for the most part so unlike most people I don’t have to wait for a holiday to plan for a short trip!!

Fort Klamath is a teensy town with a lot of ranches. In the spring the fields have a lot of water from the snow melting off the mountains and the roads are built up with little or no shoulder to pull over and take pictures. Thank God there isn’t a lot of traffic out there.

I finally watched the Wounded Knee segment of WE SHALL REMAIN on the computer…now I see why Trimbach and his cheerleaders are upset. I was laughing through a lot of it because I had never seen any footage. Sometimes when I laugh it seems inappropriate but when the truth is exposed the world rejoices and no matter how bad the truth is it has been set free which brings me great joy….It is the lies that are causing so much damage.
The thing that struck me was the uproar the government gets its self into. You would think that Brezhnev himself had landed in America and taken over Wounded Knee their paranoia is so great!! Can you imagine living with such unfounded fears every single day?? This could have been settled by simply listening to the Indians no need for guns. They just wanted to be heard…to have their very valid complaints addressed. There was so much wrong about the whole thing. I think it must be like the mass hysteria that can sometimes be experienced by a crowd only it is stretched over a few generations….some fear that what they have done is going to be done to them. I am also reading a book called FBI SECRETS An FBI Agent’s Expose’ by M.Wesley Swearingdon. You know he was a Hoover guy like G.Gordon Liddy he turns his first name into an initial!
They could have easily done a five part series on just the occupation of Wounded Knee. There is so much that was left out. Somewhere on alt.native I think there was a thread with Richard Two Elks response and something about why they didn’t interview him…I will try to get to that on the next post. My time management is lacking these days! Also I need to watch the program again because one woman was talking about the Commission on Civil Rights which is the subject today but I was trying to clean my kitchen so I didn’t quite get what everybody had to say and who they were.
…the U.S. Commission on Civil Rights concluded its investigation and reported that there had been “massive irregularities” during the election, that nearly all of WKLDOC’s charges could be confirmed, and that in no way could the election be considered valid. USCCR heaped blame on the bureau of Indian affairs, which by law was required to supervise the elections but which steadfastly refused to do so.
…the BIA….said they had read USCCR’s report but declined to make a single counterargument and declared the election would stand.
WKLDOC appealed Bogue’s decision first to an unsympathetic panel of the Eighth circuit and then to the U.S. Supreme Court, which in 1976 declined to hear the case.
That the Oglala people might deserve a judicial accounting for the stolen election, or that those who might deserve a judicial accounting for the stolen election, or that those who stole it and those who let it be stolen should be held answerable for their deeds did not, apparently, impress the justices of America’s highest court.
Funny how our government only upholds laws on reservations when it benefits the governments cause…otherwise the Indians are left to their own devices…which is what Wounded Knee was all about to begin with.
WKLDOC prepared the defense of its clients from and office out of the spare rooms of a fraternity house of the National College of Business in Rapid City.
WKLDOCers noticed that their comings and goings at the frat house were being scrutinized by clean-cut men…Jeanne Davies and Fritz Feiten, spotted one of the unmarked cars. It was empty of occupants but had a two way, police-style radio inside, so Feiten wrote down the car’s license plate number. As he did so, two men stepped out of a car across the street and walked up to him and Davies. they flashed FBI badges. “H-u-g-h-e-s,” Davies copied into a notebook and started to write his badge number, but Agent Hughes detracted the badge, snatched Davies’s paper, and ordered them to put their hands on the car. The WKLDOCkers asked if they were under arrest.
More agents arrived.
When the WKLDOCkers refused to give any information beyond their names, the questions turned to taunts, then to arrests.
WKLDOC had them bailed out soon enough, but on their way out the door the FBI added a federal charge-interfering with witnesses to a judicial proceeding-and the pair were re-arrested. no federal witnesses had been involved in the incident on the street, save the FBI agents themselves,
and they were not the sort of witnesses the law contemplated. But because it was Saturday night and a federal magistrate was unavailable to review the complaint, Davies and Feiten were kept locked up over the weekend, which was the real motive behind the complaint. Come Monday, the magistrate immediately dismissed the federal charge, and the city attorney did the same with the municipal public-nuisance charge. The FBI never received a reprimand for what was clearly harassment of legal workers..

POWWOW HIGHWAY II
Being the slothful book reader that I have become as of late I am finally on page 161 of POWWOW HIGHWAY. This is an easy book to read but I am so tired when I go to bed that all I can manage is a half dozen pages.
The book is much better than the movie although I need to rewatch the movie even though it wasn’t that long ago I swear my memory is so bad these days that I can’t remember most of the movie! But I’m pretty sure that there is a lot more stuff in the book than in the movie….but I don’t want to commit myself to that statement. Cause I can’t remember jack shit these days. My sister assures me this is one of those menopausal things.
Anyway the movie leaves out great things like this description of Pine Ridge:
Depression hung upon every rusty animal that lay gutted beside the road that led into the village. A muddy sunset lay its gray pallor over the gray and miserable town. Dogs didn’t care where they were going-they just loped slowly along in aimless indifference. Misery had achieved its ultimate consummation here. Sorrow and tragedy were open wounds on the very hillsides of Pine Ridge. Utter despair was a festering shriek in the slimy trickle of White Clay Creek, which could hardly be said to “run” through the garbage that was Pine ridge. To call the agency headquarters of the descendants of Crazy Horse and Red Cloud a spiritual pigsty would be a kindness.
But it didn’t matter, either. The “bros” of the Sioux Nation fought off defeat and despair with the best weapon any nation had ever had for fighting off Defeat and Despair- they laughed in its face. Failure was a fucking joke! Fuck depression, they weren’t gonna let stupidity and foolishness get them down.
My brother had this writing class and the instructor did a survey of what people want to read in a story….the vast majority of the class said they DID NOT WANT TO READ LANDSCAPE DESCRIPTIONS. WTF???…IS THAT ABOUT???
Now maybe they have read too many bad writers or they are just removed from the planet we live on???
Just in case you missed the first post on POWWOW HIGHWAY this is a very funny book but well written and heartbreaking at times. There is an earlier part in the book with an equally good description of the Black Hills but the main character Philbert climbs and proceeds to masturbate his way to a life changing spiritual experience…Makes me wonder if I should be packing my vibrator along with my water next time I’m at Crater Lake!!!
